Patents and Patent Attorney

A patent is a government-issued legal document that prevents others from using, selling, offering to sell, making, and importing an invention claimed in that patent.  An issued patent is statutorily presumed valid, provides the owner with a monopoly on the claimed invention for twenty years from the filing date, and is one of the most valuable tools a business or individual can have in an IP portfolio to be successful.  A licensed and/or registered attorney who helps inventors draft patent applications and enforce patents is generally referred to as a patent attorney or a registered patent attorney with the United States Patent and Trademark Office (“USPTO”).  Please read more about patents here, or call one of our experienced patent attorneys, particularly one who is Board Certified in Intellectual Property Law, for assistance.

Trademarks and Trademark Attorney

A trademark is a word, name, symbol, or device that is used in trade with either good(s) or service(s) to indicate the source of said good(s) or service(s), and to distinguish them from the good(s) or service(s) of others.  Ensuring a trademark is adequately protected, and policed, is ESSENTIAL to any successful business.  Said another way, without trademarks, businesses would have little recourse others using the same or confusingly similar word, name, or symbol.  An attorney who helps inventors draft trademark applications and enforce trademarks is generally referred to as a trademark attorney or intellectual property attorney.  Please read more about trademarks here, or call one of our experienced trademark attorneys, particularly one who is Board Certified in Intellectual Property Law, for assistance.

A copyright is a form of protection provided to the authors of “original works of authorship” including literary, dramatic, musical, artistic, and certain other intellectual works, both published and unpublished. The 1976 Copyright Act generally gives the owner of copyright the exclusive right to reproduce the copyrighted work, to prepare derivative works, to distribute copies or phonorecords of the copyrighted work, to perform the copyrighted work publicly, or to display the copyrighted work publicly.  To read more about copyrights and how and why they are so beneficial, please visit us here, or call one of our experienced professionals for assistance

Domain Disputes

Domain disputes generally arise in the context of commercial competition, failed business relationships, misappropriation, or cybersquatting and opportunistic profiteering.  Domain disputes are generally adjudicated in state or federal courts and/or through an arbitration panel utilizing the ICANN Uniform Domain Name Dispute Resolution Policy, or “UDRP.”  Our professionals have the knowledge and experience to effectively navigate through these disputes in a time- and cost-efficient manner
